Mexican National Arrested For Being An Alien In Possession Of A Firearm During Denver Protests

DENVER – United States Attorney Jason R. Dunn today announced that Aurora resident and Mexican national Felix Missael Alva has been charged with being an alien in possession of a firearm.  Alva made his initial appearance this afternoon where he was advised of his rights and the charge pending against him.  The Denver ATF and the Denver Police Department joined in this announcement.

According to the affidavit in support of the criminal complaint, on May 30, 2020, a Denver Police detective was working in downtown Denver during demonstrations when a white Jeep stopped nearby him.  The detective was approximately 10 feet from the Jeep when he saw a male passenger produce a large black semi-automatic handgun, and from the open passenger window, heard him say, “This ain’t no peaceful protest.”  The male pointed to the sky with his left hand and then opened fire into the air while a Denver Police Department helicopter and a news media helicopter were flying overhead.  The detective heard approximately 6 to 10 gun shots.  Another Denver detective and an officer were near the Jeep during this shooting and observed the passenger fire his weapon into the air.  The driver of the Jeep then sped off.

On June 2, 2020, law enforcement went to an address where the white Jeep was found.  The vehicle was impounded and searched pursuant to a search warrant for the Jeep.  The technicians observed protest signs in the vehicle as well as a large box of artillery shell fireworks.  Then on June 4, 2020, the Aurora SWAT Team executed a search warrant at Alva’s residence.  The Denver detective who observed the shooting on May 30th approached Alva and recognized him as the individual who fired a handgun into the air on May 30, 2020.  During the search, officers located a firearm and firearm accessories in a shed behind the residence.  The firearm found on June 4, 2020 has an appearance consistent with the black semi-automatic handgun that the detective observed being fired into the air on May 30, 2020.

Law enforcement record checks revealed that Alva was not a native or citizen of the United States and that he had previously been deported from the United States.  In February 2010, he was deported from the United States to Mexico pursuant to a removal order.  It was determined that Alva had not made any lawful entries to the United States, and on May 30, 2020, he was present in the United States illegally.  As he was not in the United States legally, he was prohibited from possessing weapons.

This case was investigated by the Denver ATF and the Denver Police Department.  The defendant is being prosecuted by Special Assistant U.S. Attorney Dorothy DiPascali. The defendant is presumed innocent unless and until proven guilty.

This case is part of Project Guardian, the Department of Justice’s signature initiative to reduce gun violence and enforce federal firearms laws. Initiated by the Attorney General in the fall of 2019, Project Guardian draws upon the Department’s past successful programs to reduce gun violence; enhances coordination of federal, state, local, and tribal authorities in investigating and prosecuting gun crimes; improves information-sharing by the Bureau of Alcohol, Tobacco, Firearms and Explosives when a prohibited individual attempts to purchase a firearm and is denied by the National Instant Criminal Background Check System (NICS), to include taking appropriate actions when a prospective purchaser is denied by the NICS for mental health reasons; and ensures that federal resources are directed at the criminals posing the greatest threat to our communities. The United States Attorney’s Office has prosecuted this case with support from Project Guardian partners.

Ending local assistance in immigration enforcement will result in American family separation

We hope Stephen Dinan’s recent report (Democratic wins in Georgia create more sanctuaries) on Democrats winning elections for sheriffs here in metro Atlanta’s Cobb and Gwinnet counties sees a follow-up in about a year’s time. We want the rest of the nation to see what we know is coming as a result of George Soros and corporate-Georgia’s funding of the anti-enforcement lobby’s thirteen-year push to end the 287(g) agreements in these county jails.

We know from sad experience that American citizens are going to be hurt or killed by individuals who have no legal right to be in the U.S. after they have been released from our jails.

According to DHS, Georgia is home to more illegal aliens than is Arizona. The Migration Policy Institute says we have more illegal aliens than Lawful Permanent Residents (green card holders) and that Gwinnett’s population is almost 8% of its total. Cobb County is not far behind.

Both of these counties are formerly solid Republican bastions that have gone blue “because of demographics.”

Illegal aliens who have been captured by arrests for additional crimes are currently detected using the authority the feds provide in the respective 287(g) programs and reported to ICE for further action – including removal to their home countries.

The victorious candidates for sheriffs ran on the pledge to end 287(g) because it was finding illegals that were ‘only’ charged with non-violent crimes. We hear immigration enforcement “breaks up families” was part of their stump speech.

After January 1, 2021, sanctuary will be the new protocol. An illegal alien arrested for driving without a drivers license or another “minor offense” will be put back on the streets of Georgia. It should be noted that by federal law, all illegal aliens are deportable.

Nobody asked metro-Atlanta resident Kathy Inman her views on the new illegal alien-friendly arrangement. Somebody should have. In 2000, Gonzalo Harrell-Gonzalez had multiple contacts with various local law enforcement agencies for traffic violations but despite being in the country illegally was released each time. On Father’s Day weekend that year, Mrs. Inman’s family was permanently separated when Harrell-Gonzalez’s speeding car crashed into the rear of Inman’s vehicle stopped at a red light. Sixteen year-old Dustin died instantly. His mom, Kathy, suffered permanent and severe brain injury that put her in a wheelchair for the rest of her life.

Because they were both in comas after the horrific crash, Dustin’s dad, Billy, now deceased, and Kathy Inman were unable to attend their only child’s funeral. This innocent and loving American family was permanently separated because an illegal alien was allowed into the U.S. and illegally given a job – and because local law enforcement did not detect or report his illegal immigration status to federal authorities. Harrell-Gonzalez escaped capture and is safe in Mexico.

Literally thousands of American families have suffered at the hands of illegal aliens who were released from custody by “progressive” law enforcement officers. But these families’ horror is quietly regarded as merely ‘the cost of doing business’.

Viewers outside ‘the Peach State’ should know that Georgia state government has long been a totally Republican-owned and operated affair that endlessly boasts of the status of “best state in which to do business.”

Many loyal Republican voters here are scratching their heads trying to comprehend how Democrats were able to find votes to elect sheriffs who promised to eliminate the use of a tool to rid their communities of illegals by ending the 287(g) enforcement programs.

The same corporate-funded, far-left groups that worked to attack law enforcement for using 287(g) with hate-filled race-baiting have proudly provided an answer: Between 2016 and 2020, Georgia’s number of Hispanic voters swelled by 72 percent according to analysis by the Democratic firm TargetSmart. They also boast that most of these new voters are young, first time voters.

So, in formerly solid GOP Georgia, where did much of the new votes come from to end 287(g) – and help elect a Democrat president?

The new voters are mostly the U.S.-born offspring of the illegals who have been allowed to provide the black-market labor the Establishment Republican officials count on to keep wages low and profits high. Simply put, “anchor babies” do not vote Republican. Who knew, right?

We have taken to referring to our new state as “Georgiafornia.”

DEAR EDITOR: In coverage of a public panel discussion on the 287(g) program in Gwinnett in which I participated “Sparks fly at meeting on Gwinnett jail immigration program) the Daily Post added in the fact that the discredited Southern Poverty Law Center has listed the Dustin Inman Society as an “anti-immigrant hate group.”

The Daily Post did not note that the SPLC made the decision for this false and hate-mongering categorization in the same time frame it began lobbying against legislation aimed at illegal immigration that we support in the Georgia Capitol, 15 years after we began our fight and after the SPLC told the Associated Press they disliked our activism in favor of that legislation. What a handy way to oppress political opposition.

For responsible news coverage, spreading the SPLC’s smears should come with information on their agenda and the fact that they are being sued by more than 60 groups for these false, but profitable, accusations of “hate.”

Georgia is home to more illegal aliens than green card holders and more than Arizona. Gwinnett County is the illegal home to about 72,000 victims of borders – about 8% of the total population.

We proudly support the 287(g) program, Sheriff Conway and the brave ICE Agents who risk their lives to fight the crime of illegal immigration. For people who cannot discern the difference between immigrants and illegal aliens, it is important to remember that real immigrants do not require amnesty and have no reason to fear enforcement.

Letters: Addressing the inaccuracies relayed during Gwinnett’s recent 287(g) meeting

The event was an opportunity to share our perspective about the 287(g) program, listen to the concerns of our community and dispel any misinformation residents of our community may have about this important program.

Our Public Information Officer represented our Office and a representative from I.C.E. spoke on their behalf. Commissioner Fosque required we provide a third panelist, so Mr. D.A. King was added to the discussion because of his thorough understanding and support of the 287(g) program, along with his experience in helping create immigration laws in Georgia. He participated as an independent subject matter expert, not an “official representative” of the Gwinnett County Sheriff’s Office.

Mr. King showed professionalism and restraint during the meeting, which sadly turned from the desired information-sharing forum to unfair and unwarranted name calling and misleading innuendo.

The loudest voices are heard until an educated voice speaks, so it’s imperative that we take every opportunity to fully explain the facts of this program to allow all Gwinnett residents to make an educated decision whether or not to support it.

Contrary to what you may have heard, this program has nothing to do with immigrants or checking immigrant status. It’s about criminals committing crimes in Gwinnett County. Our specially trained deputies can only screen arrestees for their immigration status after they are charged with a crime and brought to our jail.

It’s important to understand that law enforcement services are equally available to everyone in Gwinnett County, regardless of immigration status. Local law enforcement officers have no authority over anyone’s immigration status in our community, despite efforts by some to make law abiding people think otherwise. There is truly no reason for anyone to fear this program, unless they’re committing crimes in our community as illegal aliens.

I strongly believe the 287(g) program improves public safety by serving as a deterrent to criminal illegal aliens and ensuring they are not returned to our community when they’re released from jail or prison. It also saves taxpayer dollars by keeping our average daily jail population down. This program is not about politics. It’s about utilizing every tool at our disposal to serve the citizens of Gwinnett County, which I am sworn to do.

I’m disappointed we were unable to come together as a community to share differing opinions in a civil manner. The Gwinnett County Sheriff’s Office and every deputy under my command will continue to serve and protect everyone in this county professionally and within the constitution we are sworn to uphold.

All Hispanics are not opposed to immigration enforcement

My name is Maria Silvia Montoya and I am a proud American Latina and board member of The Dustin Inman Society. I have recently returned to Texas from Georgia, but continue to monitor Georgia politics and immigration issues there.

D.A. King, a personal friend and founder of The Dustin Inman Society, has been committed for many years to fairness and helping people understand the truth about immigration and the law.

What makes people uncomfortable is that he correctly points out that Georgia has more illegal immigrants than Arizona; and more illegals than green card holders. I am outraged that, currently, speaking the truth and insisting that existing laws be enforced makes you a “racist” to some people.

I am also repulsed by the idea that news organizations continue to give credence to the SPLC as a reliable arbiter of extremism and “hate”. The Anti Defamation League has criticized the SPLC for faking a “hate group” crisis; and the SPLC has been reprimanded by the DOJ for “unprofessional and frivolous behavior in immigration court proceedings”.

A smear on The Dustin Inman Society is a smear on me and I take this very personally.

The Dustin Inman Society was formed to never forget Dustin Inman, a sixteen-year-old American boy killed by an illegal alien in a senseless traffic accident. Dustin’s parents, Kathy and Billy, were knocked unconscious and missed their only child’s funeral, and just recently, Billy Inman died. Kathy remains in a wheelchair. To this day Gonzalo Harrell-Gonzalez, the illegal alien who killed Dustin remains a fugitive and justice has not been served for this horrible family tragedy.

The Dustin Inman Society continues to fight for justice for victims of illegal immigration crime through legislation and the enforcement of existing laws. Like D.A. said, “nobody is anti-immigration at the Dustin Inman Society” and nobody is anti-Hispanic, including this proud Latina. I pray your coverage of this issue and the Dustin Inman Society is much more accurate and balanced in the future.

Sheriff Butch Conway deserves praise, not condemnation

Duluth Councilman Kirkland Carden recently condemned Sheriff Butch Conway for including D.A. King, president of the Dustin Society, as a panelist in a recent meeting regarding the Gwinnett County jail’s 287(g) program (“Duluth councilman calls for condemnation of sheriff,” Aug. 4, A1.)

This federal/county joint program simply identifies the immigration status of criminals already housed in the Gwinnett jail.

Carden called King “a bigot” simply because King opposes the massive illegal immigration abuses of our country. I have met Mr. King on several occasions in the past and consider him to be knowledgeable and concerned, but certainly not a bigot.

I find it ludicrous that this article claimed the Southern Poverty Law Center (SPLC) lists the Dustin Inman Society as an “anti-immigration hate group.” The SPLC has received a grade of “F” from Charity Watch, has been de-listed by the FBI as a reliable information source and has been widely called “essentially a fraud.”

I applaud the efforts by Sheriff Butch Conway for having a diverse panel and applaud D.A. King for his valuable advice and information. I criticize Duluth councilman Kirkland Carden for his own bigotry, and would only wish that he would stop protecting criminal illegal aliens and put the legal residents and citizens before his narrow, selfish political goals.

After 16 years in the Atlanta area my family recently returned to Texas where I grew up in a border town. We still monitor Georgia politics, especially immigration issues. Our friend and founder of the Dustin Inman Society, DA King, has been committed for many years in helping people understand the truth about immigration and the law.

He correctly points out that Georgia has more illegal immigrants than Arizona; and, amazingly, more illegals than green card holders. I assure you, this fact is not helping middle-class or low-income Americans in Georgia of any description.

As a proud Latina donor and board member of The Dustin Inman Society, I was stunned that you passed along the preposterous “hate map” listing from the defamatory and dishonest SPLC. None of us at the Dustin Inman Society attack immigrants – or Hispanics. Using the SPLC as a reliable arbiter of ‘extremism’ and “hate” is repugnant and reckless, especially for a large, TV newsroom. I see your standards have declined since we lived in the Atlanta area.

Surely you are aware of the criticism by the Anti Defamation League of the SPLC for its faking a “hate group” crisis and reprimand by the DOJ for “unprofessional and frivolous behavior in immigration court proceedings”?

Tactics and accusations by the SPLC are very questionable, a fact WSB TV News omits from their reporting.

My assumption is that WSB is more dedicated to fairness and telling the truth in journalism than the SPLC. Am I wrong?

Departments of Justice and Homeland Security Release Quarterly Alien Incarceration Report Highlighting the Negative Effects of Illegal Immigration and the Need for Border Security

President Trump’s Executive Order on Enhancing Public Safety in the Interior of the United States requires the Department of Justice (DOJ) and the Department of Homeland Security (DHS) to collect relevant data and provide quarterly reports on data collection efforts. On June 7, 2018 DOJ and DHS released the FY 2018 1st Quarter Alien Incarceration Report, complying with this order.[1] The report found that more than one-in-five of all persons in Bureau of Prisons custody were known or suspected aliens, and 93 percent of confirmed aliens in DOJ custody were in the United States unlawfully.

“The illegal immigrant crime rate in this country should be zero,” said Attorney General Sessions. “Every crime committed by an illegal alien is, by definition, a crime that should have been prevented. It is outrageous that tens of thousands of Americans are dying every year because of the drugs and violence brought over our borders illegally and that taxpayers have been forced, year after year, to pay millions of dollars to incarcerate tens of thousands of illegal aliens. That is another reason why the Department of Justice under President Trump’s leadership has instituted a zero tolerance policy for illegal entry on our Southwest border. Today’s report is yet another reminder that we must continue this policy and help fulfill President Trump’s goals of restoring lawfulness to our immigration system and ensure that immigration serves the good of this country.”

“Bad actors know well our legal loopholes which act as a magnet for illegal immigration,” said Secretary Nielsen. “As DHS continues to carry out President Trump’s immigration priorities to keep America safe, Congress must urgently act to close dangerous loopholes that attract criminal aliens and also inhibit our ability to remove them.”

Section 16 of the Executive Order directs the Secretary of Homeland Security and the Attorney General to collect relevant data and provide quarterly reports regarding: (a) the immigration status of all aliens incarcerated under the supervision of the Federal Bureau of Prisons; (b) the immigration status of all aliens incarcerated as federal pretrial detainees under the supervision of the United States Marshals Service; and (c) the immigration status of all convicted aliens in state prisons and local detention centers throughout the United States.

A total of 57,820 known or suspected aliens were in in DOJ custody at the end of FY 2018 Q1, including 38,132 persons in BOP custody and 19,688 in USMS custody. Of this total, 42,284 people had been confirmed by U.S. Immigration and Customs Enforcement (ICE) to be aliens (i.e., non-citizens and non-nationals), while 15,536 aliens were still under investigation by ICE to determine alienage and/or removability.

Among the 42,284 confirmed aliens, 39,413 people (93 percent) were unlawfully present. These numbers include a 62 percent unlawful rate among 38,132 known or suspected aliens in BOP custody and a 78 percent unlawful rate among 19,688 confirmed aliens in USMS custody.

Approximately 16,233 aliens in USMS custody required housing in state, local, and private facilities, which cost $1,458,372.72 a day.

For the first time, the Quarterly Alien Incarceration Report included examples of newly sentenced or incarcerated aliens in BOP custody. These examples include, but are not limited to:

• Anibel Rondolpho Rodriguez, an illegal alien from Honduras who was residing in Freeport, NY, was sentenced to 45 years in prison after he pled guilty to racketeering charges, two murder conspiracies, two attempted murders, and threatening to commit assault.

• Eduardo Martinez, an illegal alien who was residing in Fort Wayne, Indiana, was sentenced to 324 months in prison after he pled guilty to possession with intent to distribute more than a kilogram of heroin, distribution of over 50 grams of methamphetamine, and possession of a firearm.

• Pedro Quintero-Enriques, an illegal alien from Mexico who was residing in Summerdale, Alabama, was sentenced to 108 months in prison after he pled guilty to illegal reentry after deportation and felon in possession of firearms.

This report does not include data on the alien populations in state prisons and local jails because state and local facilities do not routinely provide DHS or DOJ with comprehensive information about their inmates and detainees—which account for approximately 90 percent of the total U.S. incarcerated population.

Information Regarding Immigration Status of Aliens Incarcerated Under the Supervision of the Federal Bureau of Prisons

The Department of Justice’s Bureau of Prisons (BOP) has an operational process for maintaining data regarding foreign-born inmates in its custody. On a quarterly basis, BOP supplies this information to U.S. Immigration and Customs Enforcement (ICE). ICE, in turn, analyzes that information to determine the immigration status of each inmate and provides that information back to BOP.

Out of the 183,058 inmates in BOP custody, 38,132 (twenty-one percent) were reported by BOP as known or suspected aliens. Further details regarding these 38,132 known or suspected aliens are as follows:

• 20,976 (55 percent) were unauthorized aliens who are subject to a final order of removal;

• 11,698 (31 percent) remain under ICE investigation;

• 2,850 (seven percent) were unlawfully present and now in removal proceedings;

• 2,484 (approximately seven percent) were lawfully present aliens but are now in removal proceedings; and

• 124 were aliens who have been granted relief or protection from removal.

Information Regarding the Immigration Status of Aliens Incarcerated as Federal Pretrial Detainees

USMS identified 19,688 confirmed aliens under ICE investigation detained at USMS facilities. Further details regarding these 19,688 confirmed aliens are as follows:

•13,858 (70 percent) were aliens who are subject to a final order of removal;

• 3,838 (19 percent) remain under ICE investigation;

• 1,560 (7.9 percent) were unlawfully present and now in removal proceedings;

• 387 (approximately two percent) were lawfully present but are now in removal proceedings; and

•45 were aliens who have been granted relief or protection from removal.

Pending Charges Against Confirmed Aliens in USMS Custody

Of the 19,688 confirmed aliens in USMS custody, 10,971 (56 percent) were in custody for an immigration related offense. Additionally, 4,665 (nearly 24 percent) aliens were in custody for drug related offenses. Further details regarding the related charges of these inmates are as follows:

• 974 (approximately five percent) were in custody for supervision violations;
• 889 (approximately five percent) were in custody for property offenses;
• 391 (approximately five percent) were in custody for weapons violations;
• 378 (approximately two percent) were in custody for violent crimes;
•745 (approximately four percent) in custody were material witnesses.

Immigration Status of All Convicted Aliens Incarcerated in State Prisons and Local Detention Centers Throughout the United States

Some state and local jurisdictions already take proactive measures to make this data available to the public. For example, the Texas Department of Public Safety publishes data online regarding criminal alien arrests and convictions. These data do not account for all aliens in the Texas criminal justice system, as they are limited to criminal alien arrestees who have had prior interaction with DHS resulting in the collection of their fingerprints.

As reported by the Texas Department of Public Safety (DPS), 251,000 criminal aliens have been booked into local Texas jails between June 1, 2011 and April 30, 2018, according to DHS status indicators. These criminal aliens were charged with:

• More than 663,000 criminal offenses;
• 1,351 homicides;
• 7,156 sexual assaults;
• 9,938 weapons charges;
• 79,049 assaults;
• 18,685 burglaries;
• 79,900 drug charges;
• 815 kidnappings;
• 44,882 thefts;
• 4,292 robberies.

The Departments continue to progress towards establishing data collection of the immigration status of convicted aliens incarcerated in state prisons and local detention centers through the Department of Justice’s Office of Justice Programs, Bureau of Justice Statistics and the Department of Homeland Security’s Office of Immigration Statistics.

Dear Decaturish,

My family recently returned to Texas where I grew up in a border town after 16 years in the Atlanta area. We still monitor Georgia politics, especially immigration issues. The founder of the Dustin Inman Society, DA King, has been committed for many years in helping people understand the truth about immigration and the law. He correctly points out that Georgia has more illegal immigrants than Arizona. I assure you, this is not helping middle-class or low-income Georgians.

As a proud Latina donor and board member of The Dustin Inman Society, I was stunned to read that you passed along the misinformed insult regarding The Dustin Inman Society from Jim Galloway at the AJC, who is using the SPLC as a reliable arbiter of ‘extremism.’ Surely you are aware of the criticism by the Anti Defamation League of the SPLC for its faking a “hate group” crisis and reprimand by the DOJ for “unprofessional and frivolous behavior in immigration court proceedings”? Tactics and accusations by the SPLC are very questionable, a fact the AJC conveniently omits from their reporting. My hope is that Decaturish.com is more dedicated to fairness in journalism than Jim Galloway, the AJC – and the SPLC.

Dear Decaturish,

As an immigrant and an advisory board member of the Dustin Inman Society, I find your recent news article ( “Lt. Governor Casey Cagle escalates fight with Decatur using state immigration board”) that curiously repeats the inaccurate AJC/SPLC characterization that the Dustin Inman Society is “extreme” for insisting that our immigration law be enforced to be extremely offensive.

My parents and aunts and uncles fled a communist regime and spent years in refugee camps, and only emigrated after finding sponsors. They went through the proper steps.

One of the most important civics lessons I learned as a schoolgirl in Rochester, New York, in the 1960s was that the United States system was based on fairness.

Liberal or not, to blur the lines between legal and illegal, as Jim Galloway and the SPLC have repeatedly done, is a violation of the underlying principles of American justice and an insult to all real immigrants. The Dustin Inman Society, led by Mr. D.A. King is pro-enforcement on immigration. It appears that the Southern Poverty Law Center and Jim Galloway at the AJC take a counter position to that agenda. Is that the case for Decaturish.com too?

Dear Decaturish,

As a Black American conservative and proud member of the Board of Advisors of the Dustin Inman Society, I was saddened to see the report on the Immigration Enforcement Review Board that seemed to stray into smear politics.

I have been a friend of D.A. King for more than a decade and have worked alongside him as a volunteer at the Gold Dome to educate legislators on our illegal immigration crisis. I have also watched the SPLC smear conservative political opponents as “hate groups” in an effort to discredit our work. Referring to D.A. King as anything but an honest, hard working patriot who believes in immigration sanity is shameful.

I have had first hand experience with the SPLC when, along with many Black, Asian and Hispanic Americans, I attended an informative 2015 immigration seminar in Washington, DC that the SPLC later falsely described as a “white nationalist” meeting.

Any news outlet risks damaging its reputation by using the race-baiting and discredited SPLC as an authority on immigration and integrity.
