Moving Forward with E-Verify
Program to Check Legal Status Already 99.5% Accurate

WASHINGTON (September 18, 2008) – The E-Verify program, which allows employers to check the immigration status of new employees, has been steadily improving and is now 99.5 percent accurate, according to a new paper by the Center for Immigration Studies. This voluntary program is already screening more than one in ten new hires nationwide, and as of September 13, 2008, has processed 6.21 million queries.

E-Verify is set to expire on November 30, 2008, unless it is re-authorized by Congress. The House of Representatives has already passed a reauthorization bill by a vote of 407-2, while the Senate has not yet taken action.

To help inform debate over E-Verify, the Center for Immigration Studies has produced a thorough evaluation. The Backgrounder, entitled “If It’s Fixed, Don’t Break It: Moving Forward with E-Verify,” is authored by Janice Kephart, Director of National Security Studies at the Center and a former counsel to the 9/11 Commission. The report covers the many facets of the E-Verify debate: statistics regarding usage, cost, and effectiveness; legislative history; executive orders affecting the program; the relationship of E-Verify to worksite enforcement; and past improvements to the program as well as future goals.

The report is available online at www.cis.org. Among the findings:

# As of the first half of FY 2007, only one-half of one percent of eligible employees screened had to take additional steps to obtain work authorization; overall, the system is 99.5% accurate.

# More than 93 percent of employees are verified within five seconds; another 1.2 percent are verified within 24 hours. A new Photo Screening Tool and a streamlined procedure for naturalized citizens to receive authorization are increasing accuracy and efficiency for employers and employees; naturalized citizens no longer need to take remedial action at Social Security.

# About 5 percent of new employees are not confirmed as work authorized, mirroring the same percentage of illegal aliens estimated to be in the labor force.

# When E-Verify became web-based later in 2004, 1,533 employers had signed up. As of September 13, 2008, there are 85,816 employers representing over 446,000 sites and over 6.21 million queries processed. Currently, about 1,000 new employers join per week.

# Eleven states require use of E-Verify in certain circumstances (AZ, CO, GA, ID, MN, MO, MS, NC, OK, RI, and UT).

Officials begin to review people applying for business licenses

LAWRENCEVILLE – Gwinnett officials this week began checking the immigration status of people applying for an occupation tax certificate, which is commonly referred to as a business license.

The standard puts the county in compliance with a state law passed in 2006.

“I’m elated,” said D.A. King of the Dustin Inman Society, who lobbied for the Georgia Security and Immigration Compliance Act and has pushed for its application for years.

He said the move makes Gwinnett the third county in Georgia to correctly apply the law.

“I think it will serve as a tax savings. People who have no right to be here will go home,” he said.

Officials said the Systematic Alien Verification for Entitlements program, operated by the federal Department of Homeland Security, is already in place for applicants for housing assistance. And the federal E-Verify system has been used since July 2007 to verify the immigration status of applicants for jobs at the county and its primary contractors and subcontractors.

Officials began Monday requiring all sole owner and sole-member limited liability corporation applicants to sign an affidavit either as a U.S. citizen or legal permanent resident or as a qualified alien or nonimmigrant. The second affidavit triggers verification through the SAVE program.

“We’ve been a leader in the state in using these verification systems, and I feel strongly that tax dollars should be administered according to the full spirit and intent of the law,” Chairman Charles Bannister said.

According to a press release, the county will pay a 50 cent fee per SAVE transaction beginning Oct. 1, and the Licensing and Revenue Board of Appeals will review denied occupation tax certificate applications upon request.

(Lawrenceville, Ga., Sept. 18, 2008) – Starting Monday, Sept. 15, Gwinnett County will check the legal immigration status of applicants for an occupation tax certificate. All sole owner and sole-member limited liability corporation (LLC) applicants will be required to sign one of two affidavits. The first is for U.S. citizens and legal permanent residents. ALERT: Victory! CA Appellate Court Denies In-State Tuition for Illegal Alien Students!

In a major victory for opponents of illegal immigration, a state appellate court held that California is violating federal law by giving in-state tuition rates to illegal alien students at state colleges and universities.

The 3rd District Court of Appeal unanimously reversed the Superior Court’s dismissal of a suit brought by students who paid far more to attend college because they were out-of-state residents. The appellate court ruled that California’s law conflicts with federal law and gave the plaintiffs permission to challenge the constitutionality of the state law.

California’s AB 540, passed in 2001, makes the state one of only nine with laws allowing illegal aliens to qualify for subsidized, in-state tuition rates.

This is not the end of the case. It was remanded to Superior Court for trial, and the appellate ruling could be appealed to the state Supreme Court, but it is sweet to savor this victory for now.

Massive foreign worker increase back alive in Senate backroom negotiations

Just as we had seemed to push back attempts for massive increases in foreign workers by the U.S. House last week, we now learn the danger has risen to Orange Alert level in the Senate.

Let’s take a look at some of the millions of Americans who are being ignored by Senate staffers as they negotiate behind closed doors to bring in additional permanent immigrant workers next year:

THESE AMERICANS BEING SACRIFICED IN BACKROOM SENATE TALKS
In August, 592,000 additional Americans were added to the official unemployment rolls.
Total number of Americans who are officially unemployed, looking for a job and can’t find one? 8.28 million!
Current official unemployment rate (highest in 5 years)? 6%
Official unemployment rate considerably higher for Hispanic women: 8.7%
Rate twice as high for Black American men: 12.3%!
Look to see whether Sen. McCain or Sen. Obama show any concerns at all for these people in their Presidential races.

CLEAN E-VERIFY RE-AUTHORIZATION AGAIN IN DOUBT
We had counted on Republican Senators to agree to stand up to the blackmail of Sen. Menendez that we’ve been telling you about for the last month. (Read background in my previous blogs.) Sadly, we have learned that an undetermined number of Republican staffers are now also trying to increase foreign workers during a time of rising American unemployment.

Menendez — you may recall — has put a hold on re-authorization of the E-Verify on-line program that keeps illegal aliens out of jobs.

He has been saying he will let the Senate vote to keep the program going IF the Senate will also add hundreds of thousands more permanent immigrants. Our understanding has been that Senate Majority Leader Reid (D-Nevada) was ready last week to over-rule Menendez and bring E-Verify to the floor. And it looked like Reid was willing to do it without adding extra foreign workers.

Then at the end of the week, several Republican staffers seem to have re-opened the whole thing to add foreign workers, apparently to satisfy the demands of special interest lobbyists.

Our message to every Senate office has to be:

1. No increase in immigration and foreign workers of any kind.

2. Re-authorize E-Verify without any strings — just like the House did a month ago.
