Indictments tell how H-1B visas were used to undercut wages

Federal agents on Thursday said they arrested 11 people in six states in a crackdown on H-1B visa fraud and unsealed documents that detail how the visa process was used to undercut the salaries of U.S. workers. — Federal authorities allege that in some cases, H-1B workers were paid the prevailing wages of low-cost regions…

Washington Times editorial ROGER BARNETT – Illegal-alien outrage

Posted by D.A. King at 3:28 pm - Email the author   Print This Post Print This Post

FYI: Roger Barnett is a respected freind and a great American. I have been on Roger’s rach, in his home and seen the torment that the illegal aliens cause this man.
I also point to the definition of “Civil Rights“…which are for citizens.

EDITORIAL: Illegal-alien outrage

Few cases better illustrate how dysfunctional this country’s immigration and “justice” systems are today than that of Roger Barnett – a Cochise, Ariz., man who is being sued in federal court by a group of illegal aliens who accuse him of violating their “civil rights” for holding them at gunpoint after catching them trespassing on his property.

The illegals, who are suing Barnett with the assistance of the Mexican American Legal Defense and Education Fund (MALDEF), seek $32 million for civil-rights violations, the infliction of emotional distress, and other things – $1 million in actual damages and $1 million in punitive damages for each of the illegals who were purportedly “victimized.”

One of the illegal aliens seeking to collect his $2 million is Gerardo Gonzalez, 38, described in MALDEF’s lawsuit as a Mexican citizen. No ordinary Mexican, he. Jerry Seper of The Times reported Friday that Gonzalez is also a convicted drug dealer; in September 1993 he was convicted of possessing a controlled substance for sale and was ordered deported back to Mexico.

Gonzalez, whose illegal re-entry after removal under U.S. law would be an additional felony, was among the 11 men and five women detained by Barnett on March 7, 2004 when the rancher, now 64, approached a group of illegals, accompanied by a dog and carrying a gun. The MALDEF lawsuit accuses Barnett of having “conspired” “to hunt and detain against their will, and at gunpoint, Latino migrants.” Barnett counters that he drew his handgun because his 22,000-acre ranch is frequently crossed by illegal immigrants and drug smugglers, and that he holstered the weapon after assuring himself that the trespassers were unarmed.

In an earlier interview with this newspaper, Barnett described in detail how his property had been violated by literally thousands of illegals who destroyed his water pumps, killed livestock, destroyed fences, stole trucks and broke into his home. In reality, this lawsuit should have been thrown out before it ever got to court.

We hope that when the federal jury hearing in Tuscon, Ariz., resumes its deliberations tomorrow (Tuesday), it will reach the commonsense conclusion that Barnett owes zero damages. If anything, it should consider sanctions against MALDEF for filing such a frivolous lawsuit.

On CNN, Rick Sanchez, the race-baiting SPLC /La Raza coalition, Wall St. and the coming corporate funded amnesty-again attempt: An open letter to CNN’s John King

Posted by D.A. King at 2:31 pm - Email the author   Print This Post Print This Post

To: Mr. John King, CNN

I understand that you are doing a series of broadcasts on “Latinos” and “immigration”.

Some unsolicited insight:

“Immigrants” – like my adopted sister – by definition, join the American family lawfully, already enjoy a path to citizenship and do not require amnesty.

The same cannot be said for illegal aliens. This applies even to Hispanics.

We have nothing to apologize for when it comes to “immigration” as we as a nation take in more than one million immigrants a year from all over the world. More than any nation on the planet. Another two million or so “guest workers” many of whom scream “you can’t make me leave, I have an American born child and I like it here” !

Illegal immigration is slowing and illegals are leaving the U.S. because of increased enforcement, and the loss of job opportunities – exactly as those of us who fight that crime said would happen with the concept of “attrition through enforcement“.

We are proving that local enforcement works as a deterrent to illegal immigration – and the illegal alien lobby is howling.

The shameful presentation that Americans who demand secure borders and an equal application of the law are somehow “anti-Latino” or “anti-immigrant” is perpetuated by people who cannot find a reasonable argument for allowing everyone on the planet – or in Latin America – to come live in the USA. And because they have created a thriving business advocating for criminals.

The goal of the coaltion of the radical left and Wall St. is really open borders.

Here in the metro Atlanta area, we are nearly out of water, and there was talk three or four years ago of making I-75 twenty three lanes wide near my home. That will eventually happen. English has become an optional language in the American south and the flag of Mexico flies everywhere. Low skilled wages have been steadily declining for years.

Americans who cannot speak Spanish are being denied jobs for that reason in Georgia.

We are bailing out the banksters who illegally made mortgage loans to illegal aliens using Mexican ID.

We as a nation have the right to decide how many people we want to live in our republic and we certainly have the right to demand that our immigration and employment laws are enforced. Those of us who insist that criminal employers who draw the migrating wage-thieves here be punished are in the majority of the ever increasing number of aware and angry American people.

Sadly, the people with the courage to say exactly that are branded “racist” ( what race is illegal?) and “haters” by the race-baiting far left like MALDEF, La Raza, LULAC and that perpetual fund raising machine disguised as a law firm, the SPLC. That fact is either ignored or helped along and perpetuated by many in the MSM. The rocket scientist Rick Sanchez of CNN leaps to mind. I watched in November as he literally had an SPLC critter (Mark Potok) spew his usual hate mongering and name calling from a telephone on the air.

Sanchez literally had him phone it in!

My cat could easily defeat Sanchez (or Potok) in a debate. Having done many live CNN/FOX News hits, although I have a face for radio, I would happily paint the house belonging to any CNN producer who would get me on his show in place of my feline to expose his mindless open borders ethnic oriented agenda.

Mexico uses its military to try to secure its own borders and deports nearly as many people each year as we do….virtually all of whom are Hispanics.

Radical xenophobes and haters….si?

Most Americans don’t give a hoot about where a real immigrant comes from. But we do insist that they become assimilated and adopt to the American culture and language.

That ideal is not un-American.

We also understand that legalization – by any name – does not result in secured American borders, enforced employment laws or an end to illegal immigration. We proved that with the “one-time amnesty” of 1986. We will not forget the lesson.

Instead of the reported sixty “Latino leaders”, Obama would do well to schedule meetings with mainstream Americans who study immigration and the law. We know more about the issue than he does and we want what is best for the nation – not for special interest groups using ethnicity and skin color as victimhood and a basis for special treatment.

Obama would also do well to heed the advice of the late Barbara Jordan, the first black woman elected to congress and the Bill Clinton appointed head of his Commission on Immigration Reform from the 90’s. From Jordan in 1995: ” To gain credibility on immigration policy: “Those who should get in, get in; those who should be kept out, are kept out; and those who should not be here will be required to leave — deportation is crucial.”

On the criminal employers who lure illegals into our republic, Jordan recommended mandatory electronic verification of legal employment eligibility. “Employer sanctions can work,” she said.

Fortunately for Jordan, a 1994 Presidential Medal of Freedom award winner, 21st century ethnic hustlers, biased journalists with a clear agenda like Sanchez and Wall St. scammers in search of even more taxpayer subsidized “cheap labor’ weren’t there to attack her “extremism.” Si?

Heads up – the coming corporate funded attempt to repeat the amnesty of 1986 will be met with more defiant popular grass-roots resistance that the media – or the Congress – can ever imagine and the price of it passing would be a forever divided “new-America” that will simply become part of the envisioned “North American Community” dedicated to redistribution of the wealth, socialism and increased profit for those who are more equal in the disgusting barnyard of 21st century American politics.

Please pass this on to the suits at CNN HQ who may think they are fooling all of the people all of the time. And Sanchez.

Respectfully,

Anchor babies going home? WSJ “… During a decade in the U.S., Mexican immigrant Linex Rivera gave birth to three daughters, whose American citizenship offered her hope of staying in the land of opportunity…”

As U.S. Job Opportunities Fade, More Mexicans Look Homeward

LOS ANGELES — During a decade in the U.S., Mexican immigrant Linex Rivera gave birth to three daughters, whose American citizenship offered her hope of staying in the land of opportunity. But with job prospects drying up for her husband, Ms. Rivera last week joined a phalanx of compatriots at the Mexican consulate in Los Angeles inquiring about obtaining Mexican citizenship for their children.

“We are thinking of returning to Mexico and want our daughters to have all the rights of Mexican nationals,” says Ms. Rivera, whose children are nine, five and three.

After a historic immigration wave, many Mexicans and other Latin Americans are preparing to return to their homelands amid the deepening recession here. Mexicans who reside in the U.S. sought Mexican citizenship for their U.S.-born children in record numbers last year.

U.S. nationality has long been regarded as a prized commodity for immigrants from developing countries. Anti-illegal immigrant activists accuse Latin American migrants of giving birth to “anchor babies” in the U.S. in order to secure welfare and other benefits.

But Mexican citizenship has its own benefits. Having Mexican nationality entitles U.S.-born children of immigrants to obtain health care, education and other benefits, as well as the right to vote, in Mexico. Mexican nationals also don’t face restrictions on land and business ownership that apply to foreigners. HERE

Debunking the “E-Verify Error Rate”

Posted by D.A. King at 11:34 pm - Email the author   Print This Post Print This Post

Leadership Journal DHS

THIS is nearly a year old – E-Verify is even more accurate now. The problem with it for many people? It stops illegal aliens from getting American jobs and encourages them to leave areas where it is used.

Debunking the “E-Verify Error Rate”

Everyone agrees that illegal immigrants cross our borders because they want to work here. If we can reduce the lure of illegal employment, we can reduce the pressure on our borders.

That’s exactly what E-Verify does. When an E-Verify employer hires a new worker, the employer gets on line and fills out a short electronic form. As soon as the employer hits “send,” the system checks to make sure that the worker’s name matches his Social Security Number. If the worker is not a U.S. citizen, the system also checks to make sure his work authorization is still valid and shows the employer the picture that should be on the DHS-issued identity card. For most workers, verification is instantaneous.

E-Verify is simple, free, and highly effective in preventing illegal work. It works, and maybe that’s what the interests arrayed against E-Verify don’t like. Whatever the reason, opponents of E-Verify have resorted to charges that just don’t hold up. In this series, I debunk the myths.

The opposition to E-Verify often claims that the program has a high error rate. Some critics claim that the error rate is as high as 4% and will lead to millions of Americans losing their jobs by mistake.

To see how wrong this claim is, we need to look more closely at how E-Verify works. We can draw a precise picture of what happens to a thousand applicants who use E-Verify by using data gathered from October 2006 to March 2007 by Westat, an independent reviewer.

Of the thousand, 942 are instantly verified. Instant verification of legal workers surely can’t be an error.

Fifty-eight are told that they have to do something more to establish that they are lawfully authorized to work. Usually this means they have to go to Social Security to correct the mismatch in name and number. (Typos and similar problems are cured on line, so legal workers usually have a problem only if they changed their names or citizenship status but failed to tell Social Security of the change.)

So five of the thousand must go to Social Security and straighten out their records. For 90% of them, the process takes less than 2 days. Is that an error rate? If so, it’s ten times lower than our critics claim. And, is it really an error to tell workers that their social security credits aren’t being properly recorded? Sooner or later, the worker will want to collect benefits, and they won’t want to face doubts about who earned the credits. (Of course, straightening out Social Security records isn’t fun, but we’re working to reduce the hassle. Just a few weeks ago, we introduced software changes that will automate some of the correction process, reducing the number of legitimate workers who have to go to Social Security offices from five to two or three per thousand.)

That leaves the 53 who walk away. Is that an error rate? There are certainly people who believe it’s an error to keep illegal workers out of the U.S. workforce. But we don’t. It’s our job to enforce the immigration laws.

And common sense suggests that the walkaways are overwhelmingly likely to be illegal workers. It’s just common sense that a legal worker wouldn’t want to walk away from a job he applied for–and has been offered if he straightens out his records. It’s just common sense that a legal worker wouldn’t walk away from the opportunity to correct Social Security records he now knows are wrong – records that will have to be corrected for him to get benefits. And it’s just common sense that about five percent of E-Verify workers would walk away, since a Pew Foundation expert recently estimated that 4.9% of U.S. jobs are held by illegal workers. It’s hard to see the walkaway rate as an error; in fact, that’s the program working as it should.
