(1/26/09) While we are looking for ways to cut the Georgia budget, imagine the clamor of indignant outrage if any local government in Georgia refused to honor the 1982 U.S. Supreme Court decision dictating that American taxpayers foot the bill for K-12 education of children who have no legal right to be here.

Or the 1986 federal legislation that provides taxpayer funded emergency medical treatment regardless of ability to pay… or immigration status. Georgia’s emergency rooms long ago became taxpayer subsidized defacto free clinics for illegal aliens.

Any non-compliance with laws that benefit illegals would surely result in howls of “injustice” and angry marches in the streets staged by the same well-funded far-left fringe groups opposing enforcement of our immigration and employment laws.

Not many could doubt that the protests would be front page, top-of-the broadcast news.

Not so for the reality of most Georgia local government’s non-compliance with the Georgia Security and Immigration Compliance Act (GSICA), signed into law by Governor Perdue in 2006 and intended to protect Georgians from the organized crime of illegal immigration.

Essentially a state law saying that in Georgia we must obey existing federal immigration law, state Senator Chip Rogers’ comprehensive immigration reform legislation puts in place safeguards to help insure non-federally mandated benefits go only to those eligible.

“It’s our responsibility to ensure that our famous Georgia hospitality is not abused, that our taxpayers are not taken advantage of and that our citizens are protected,” Governor Perdue said at the bill signing.

GSICA requires a sworn affidavit of either U.S. citizenship or lawful alien status from all applicants for public benefits and use of the federal “Systematic Alien Verification for Entitlements” (SAVE) database to verify aliens’ legal status.

Rogers’ law is being ignored.

In addition to welfare, health, disability, public or assisted housing, or food assistance, public benefits also include “any grant, contract, loan, professional license, or commercial license provided by an agency of a State or local government or by appropriated funds of a State or local government”.

It would be very hard to argue that business licenses issued by cities and counties don’t qualify as commercial licenses.

It should be equally difficult to argue that illegal border crossers who escape apprehension by our brave Border Patrol Agents should be rewarded with permission to do business if they can make it into Georgia.

But that is exactly what is happening.

Nearly three years after GSICA, most local governments in Georgia are not using the mandated affidavit. A January 7, 2009 list provided by the U.S. Department of Homeland Security reveals a total of eight (8) local governments using the SAVE database.

There are 159 counties and 535 cities in Georgia.

About here, many readers may be asking themselves why we would possibly need a law telling local governments not to encourage illegal aliens to enter or remain in Georgia.

That would be playing the common sense card.

The Association County Commissioners of Georgia (ACCG) is advising counties that business licenses issued in a business license office are actually “Occupational Tax Certificates” and therefore county regulation of local businesses is not covered by that inconvenient law.

It gets even worse on the municipal level.

For example: While the city of Atlanta is laying off workers, cutting back on services and suffering budget shortfalls, that government seems to be going in the opposite direction of the letter and intent of GSICA.

While in clear defiance of GSICA, Atlanta is in compliance with its own 2004 ordinance stipulating acceptance of the Mexican issued ‘matricula consular’ ID – which is needed only by illegal aliens.

Mayor Franklin’s quote on recognition of the Mexican ID at the time: “it helps to promote public safety and public health by allowing Mexican nationals to access services”.

According to a 2007 Congressional Budget Office Report ( ‘The Impact of Unauthorized Immigrants on the budgets of State and Local Governments’), because of their low wage levels any taxes derived from illegal aliens don’t begin to cover the services they consume for education, health care, and law enforcement.

Who pays the difference? The hapless citizen forced to subsidize the same black market labor that is taking American jobs and lowering wages.

The well respected Federation for American Immigration Reform (FAIR) recently published a report estimating that Georgia currently spends about $1.6 billion a year for illegal aliens and their dependents to provide K-12 education, public health care, and incarceration of criminals.

It has been repeatedly proven that illegals migrate out of areas where the law is actually enforced.

Hopefully, state officials looking for ways to cut the budget and provide services and jobs to Americans realize that if local governments are forced to end their amnesty programs for illegal aliens, we can slow the financial bail-out for these criminals.

Enforcement works. We should try it.

The common sense card again.

Georgia 2009 legislative session opens

Legislation that could withhold state funds from local governments not in compliance with the Georgia Security and Immigration Compliance Act is moving forward this session.

State Rep. Calvin Hill (R-Hickory Flat) said the legislation was proposed out of a policy committee appointed by the Speaker of the House. He said the final bill has not been completed.

“We don’t pass Georgia law to be ignored,” he said.

In 1995, Barbara Jordan, the first black woman elected to Congress from the Deep South, was chairing the Commission on Immigration Reform. At that time, she said “it is both a right and responsibility of a democratic society to manage immigration so that it serves the national interest.”

Perpetuating the crime of illegal immigration does not serve the national interest. Sen. Harry Reid, D-Nev., has recently and quietly introduced an amnesty bill in Congress that is against the best interests of our nation.

In 1986, a “one-time amnesty” was provided to almost 3 million illegal aliens in our country. Since that time, more than 20 million illegal aliens have entered the United States. Clearly, amnesty rewards illegal behavior, encourages increased illegal immigration and leaves our borders unchecked.

For the American Civil Liberties Union, the Georgia Association of Latino Elected Officials and similar groups, the goal is open borders. These well-funded un-American far-left groups do everything they can to oppose enforcement of our immigration and employment laws. The result is more layoffs for American workers and lower wages.

Illegal aliens do the jobs that Americans always had done before wages were artificially – and illegally – depressed.

According to the Congressional Budget Office, illegal aliens consume three times the amount of social services as they contribute in taxes. Illegal immigration is draining our economy and straining resources.

As an black conservative, I agree with Jordan’s further statement on immigration policy: “Those who should get in, get in; those who should be kept out, are kept out; and those who should not be here will be required to leave … Deportation is crucial.”

Illegal aliens must leave.

For applying for the 287(g) program, Sheriff Butch Conway deserves the gratitude and support of not only Gwinnett citizens but the immigrants who are welcomed here because they came according to our laws.

By howling in opposition to the removal of criminal aliens from our community, the fringe groups on the far left, whose real goal is officially open borders, have clearly shown us how much they fear 287(g) and its potential effectiveness.

Everywhere 287(g) has been implemented nationwide – and in Georgia – illegals leave for more hospitable places.

The 13-year-old federal tool provided to local law enforcement is a very effective deterrent. If we get rid of several thousand illegals each year who have been arrested for crimes in addition to illegal immigration, illegal employment and ID theft, we will save tax dollars to be used by legal residents, not to mention jobs.

If many more choose to move out because of 287(g), all the better. It seems to be a no-brainer and much closer to how it is done in Mexico.

If the ACLU and their fellow travelers are against 287(g), I support it completely.

Thanks to Sheriff Conway, to ICE and to all the law enforcement officers who risk their lives to make our community safe.

Officials need 287(g) to control immigration

Why does Gwinnett County need 287(g) authority to help enforce immigration laws?

Illegal immigration is a serious problem and enforcement works as a solution. It has been proven over and over nationwide – including here in Georgia – that when 287(g) comes into a community, illegal aliens migrate out.

Most Americans regard this fact as a very positive improvement.

In 1995, the Bill Clinton-appointed chairwoman of the Commission on Immigration Reform was the late Barbara Jordan, D-Texas, the first black woman elected to Congress from the deep South. She said, “It is both a right and responsibility of a democratic society to manage immigration so that it serves the national interest.”

It does not serve the national interest to perpetuate the crime of illegal immigration.

The 1986 attempt to solve the crisis was “one-time amnesty” provided to 3 million illegal aliens in our country. Since then, more than 20 million illegal aliens have entered the U.S.

Clearly, amnesty rewards illegal repeat behavior and encourages increased illegal immigration. It is not a solution; however, 287(g) is.

In her 1995 Congressional testimony, Jordan said, “It is necessary to make distinctions between those who obey the law, and those who violate it … We disagree with those who label our efforts to control illegal immigration as somehow inherently anti-immigrant. Unlawful immigration is unacceptable.”

Far-left, open borders groups such as the ACLU tout that they uphold the civil rights of “immigrants.” An illegal alien is not an immigrant. Immigrants come lawfully.

Civil rights, by definition, are reserved for citizens of our country, not those who are here illegally. Therefore, when illegal aliens choose to leave their homeland, choose to separate from their families and choose to enter our country illegally, they also choose the consequences befitting a criminal.

We must strive to prevent illegal immigrants from entering our country. If they get past the Border Patrol, they must be apprehended by law enforcement; 287(g) helps solve this problem.

Open borders are the goal of the ACLU, the Mexican-American Legal Defense and Education Fund (MALDEF), the Georgia Association of Latino Elected Officials (GALEO) and similar fringe groups.

Open borders would lead to more layoffs for American workers and an increased demand for cheap labor and low wages.

Through lowered wages and lost jobs, the first victims of illegal immigration are blacks and native-born Latinos. Illegal aliens do the jobs that Americans would do if the wages were not artificially depressed.

Illegal immigration is draining our economy and straining resources. According to the U.S. Congressional Budget Office, illegal aliens consume almost three times the amount of social service assistance as they contribute through taxes.

As an African-American, Christian conservative, I agree with Jordan when she stated what was necessary to gain credibility on immigration policy: “Those who should get in, get in; those who should be kept out are kept out; and those who should not be here will be required to leave. … Deportation is crucial.”

Illegal aliens must leave; 287(g) must be put in place.
