{"id":1909,"date":"2008-11-07T15:27:08","date_gmt":"2008-11-07T19:27:08","guid":{"rendered":"http:\/\/www.thedustininmansociety.com\/blog\/?p=1909"},"modified":"2008-11-28T16:50:48","modified_gmt":"2008-11-28T20:50:48","slug":"illegal-aliens","status":"publish","type":"post","link":"https:\/\/www.thedustininmansociety.org\/blog\/2008\/11\/07\/illegal-aliens\/","title":{"rendered":"ILLEGAL ALIENS!"},"content":{"rendered":"<p><strong>The California Appellate Court, Third Division<br \/>\nJudges  Sims, Raye and Hull, said in a decision<\/strong>:<\/p>\n<p><a href=\"http:\/\/caselaw.lp.findlaw.com\/data2\/californiastatecases\/c054124.pdf\">http:\/\/caselaw.lp.findlaw.com\/data2\/californiastatecases\/c054124.pdf<\/a><\/p>\n<blockquote><p>&#8220;Defendants prefer the term \u201cundocumented immigrants.\u201d However,defendants do not cite any authoritative definition of the term and do not support their assertion that the terms \u201cundocumented immigrant\u201d and \u201cillegal alien\u201d are interchangeable. We consider the term \u201cillegal alien\u201d less ambiguous. Thus, under federal law, an \u201calien\u201d is \u201cany person not a citizen or national of theUnited States.\u201d (8 U.S.C. \u00a7 1101(a)(3).) A \u201cnational of the United States\u201d means a U.S. citizen or a noncitizen who owes permanent allegiance to the United States. (8 U.S.C. \u00a7 1101(a)(22).) Under federal law, \u201cimmigrant\u201d means every alien except those classified by federal law as nonimmigrant aliens. (8 U.S.C. \u00a7 1101(a)(15).) \u201cNonimmigrant aliens\u201d are, in general, temporary visitors to the United States, such as diplomats and students who have no intention of abandoning their residence in a foreign country. (8 U.S.C. \u00a7 1101(a)(15)(F), (G); Elkins v. Moreno (1978) 435 U.S. 647, 664-665 [55 L.Ed.2d<br \/>\n614, 627-628] [under pre-1996 law, held the question whether nonimmigrant aliens could become domiciliaries of Maryland for purposes of in-state college tuition was a matter of state law].) The federal statutes at issue in this appeal refer to\u201calien[s] who [are] not lawfully present in the United States.\u201d (8 U.S.C. \u00a7\u00a7 1621(d), 1623.)
