Tina Gardner was left severely brain-damaged, and Scott Gardner was killed. <\/p>\n<p>The driver, Ramiro Gallegos, had a blood alcohol concentration of .22, nearly three times the legal limit.<\/p>\n<p>\u201cMy son didn\u2019t have to die,&#8221; his mother, Emily Moose, said. &#8220;The man that drove the truck and took his life had been in front of a judge five times.
