Georgia-based pro-enforcement immigration watchdog group opposes amnesty-again – says “no” to legalization agenda led by Marco Rubio, Barack Obama & John McCain et al

Today, Dustin Inman Society president D.A. King announced his organization’s intent to actively oppose the 2013 attempt to repeat the 1986 amnesty for illegal aliens.

Including anti-amnesty White House protests in 2005 and 2007, King is a veteran of successfully organizing rallies and events aimed at educating the American public on the consequences of amnesty. “Sadly, Americans will find it necessary to again march in the streets of their own country to defend it and the rule of law upon which we were founded. Reagan’s 1986 capitulation only increased illegal immigration” King said today.

King noted that Republican John McCain faired quite poorly in his 2008 presidential election bid with Hispanics despite his promise of another amnesty.

King calls on the Georgia delegation in Washington to pick a side and to quickly announce their current position on the concept of legalization for illegal aliens and Obama’s immigration agenda.

“By now, even the least connected Americans realize that the term “comprehensive immigration reform” is 21st century code for a repeat of the “one-time” amnesty of 1986” noted King. “Despite the national media’s agenda-driven refusal to honestly report it, the fact is that legal status for illegal aliens is unconditional and immediate in the recently revealed and deceptive bipartisan “framework” for another amnesty announced this week from the Senate.”

“The President’s outline is a similar attempt to deceive the American people into believing that rewarding illegal aliens with American citizenship will somehow deter illegal immigration. To do so dishonors and devalues the entire concept of what it means to be an American” said King. He pointed to the nation of Mexico as an example of how the United States should approach national security and the enthusiastic enforcement of immigration and employment laws.

“The illegal alien lobby is already brazenly demanding that even the 1986-like empty promise of future enforcement be discarded by the president and other proponents of the current legalization scheme” King said. He pointed at the latest amnesty ‘framework” offered up by the ACLU as just one example of that dangerous fact.

“The anti-enforcement, open-borders coalition of the race-baiting La Raza network, the ACLU, the Chamber of Commerce, the Democrats, Big Religion, Big Academia and some shameful anything-for-a campaign-buck collaborators in the Republican party will never stop fighting against enforcement” warned King. “Amnesty-again will not change that fact. Americans must be ever vigilant and become aware and active in defense of our right to have and enforce borders and immigration laws” he said.

“How is adding 12-20 million newly-legalized mostly low-wage, uneducated, entitlement- demanding potential Democrat voters going to help the budget, unemployment, American workers or the supposedly small government, low-tax GOP?” King asks.

Which side will the Cobb Board pick on IMAGE? Yours? Or the illegal’s?

Imagine a campaign in favor of the use of stolen Social Security numbers and fraudulent ID documents.

Crazy, impossible and “never happen” you say? Hardly. The shameless illegal alien lobby does it quite often. They frame it as a “civil-rights” issue and say they are defending “immigrants.” They hope you won’t know that immigrants who are in the USA lawfully have genuine Social Security numbers, real American IDs and no need for stolen or fake SSNs.

Imagine any elected official in Georgia ignoring the plight of jobless citizens.

Now, imagine being an allegedly conservative chief executive of an Atlanta-area county and not rushing to take advantage of an available no-cost tool called “IMAGE certification” that would expose the use of stolen Social Security numbers by workers paid with tax funds.

This is not impossible either. And you don’t need to just imagine. Despite what he has said about leading and managing, it is exactly what is happening right now here in Cobb County, Ga., with county boss Tim Lee. And perhaps with one or more of our district commissioners.

Maybe they have forgotten the multiple 2010 news reports of repeated revelations of illegal workers taking coveted taxpayer-funded construction jobs building the Cobb Court House. Or the fact that it happened so many times and became so embarrassing that the sheriff had to be called in with armed guards to check workers’ IDs at the entry to the Court House construction site.

Amazingly, the obvious and nearly fool-proof solution to such future scandals might not be used here in Cobb County. A change in county code to require contractors to simply apply to use the no-cost federal “IMAGE certification” tool to detect fake IDs and illegal workers on county jobs is not a sure thing.

And Tim Lee has flip-flopped on his promise to extend the IMAGE program from the BOC itself to county contractors.

Yes, last May the BOC cast a unanimous, bipartisan vote to sign an agreement with ICE to become IMAGE-compliant — which, again, mostly means they have allowed the feds to check the BOC’s hiring records for compliance with federal law and to sniff out bogus and stolen IDs used by workers at hiring — including stolen Social Security numbers.

At the May 2012 signing ceremony, Lee said “The IMAGE agreement will help prevent possible terrorist attacks and protect employees against discrimination based upon citizenship or natural origin.” And he was right.

“The message, if there is one, is that Cobb County takes its responsibility very seriously to make sure that everything possibly that could be done is being done to make sure the laws are being followed in our county, and to make sure there’s an opportunity for equal employment for those that deserve it,” Lee told this newspaper after that meeting.

By participating in the IMAGE program, companies can reduce unauthorized employment and the use of fraudulent identity documents.

As part of IMAGE, ICE and U.S. Citizenship and Immigration Services will provide education and training on proper hiring procedures, and fraudulent document detection.

The ugly truth is that Tim Lee’s enthusiasm for rooting out black-market labor from the county-paid contractor workforce has waned. In a departure from his campaign promise, Lee now says that he is undecided on whether he will support the IMAGE requirement for contractors. How? He is using the endless and ever-dependable political goop “until examining any unintended consequences such as the cost of implementation to manage it and making us uncompetitive for new business.”

Imagine telling that to the Cobb’s unemployed and working poor who would love to look for a better life by having a public job now held by an illegal worker using a stolen Social Security number.

Passing the IMAGE ordinance sponsored by Commissioners Bob Ott and JoAnn Birrell shouldn’t be a difficult decision. The coming vote on this county policy will be long remembered.

The entire Cobb County Board of Commissioners has a clear choice here. Not all choices in life offer this clarity. Align with law-abiding voters — or with the counterfeit identification enthusiasts and the big money Chamber of Commerce.

It will be very educational to watch them pick a side.

There will be a hearing on the proposed policy at 7 p.m. Tuesday at the Cobb Government Building on Marietta Square.

Pick a side.

From my friend Glenn Spencer who lives on the the Arizona Mexico border. And I mean on the border.

I am writing this at 5:42 AM on Wednesday and the outside air temperature here on the border in Hereford, Arizona is 19 degrees F. It has been this cold for the past four nights. Still, people are crossing the border under these conditions. Are they just looking for work – or is something else going on?
Omaha is a US Border Patrol helicopter. It is Sunday night, Jan. 13.
The location is about five miles west of Nogales, Arizona.
Omaha: “We’ve got bodies running all over the place. I’ve got my lights on them now.”
Another agent reported: “The driver hit a pedestrian and taking off. And then I saw him at Court (sp?) and Morely (sp?) and the guy looked straight at me and struck my vehicle. He tried to hit me head-on and I swerved – and then he continued northbound on Morely (sp?) and he eventually wiped out under the 82 bridge on Morley.”
A National Guard aircraft reported activity just south of the border “I’m looking at nine fires on my screen right now,” he reported. The fires are there to warm people in Mexico waiting for the right moment to cross into the U.S.
As the wholesale invasion of American unfolds in the desert Southwest — day and night — and in severe weather conditions – our media spend their time counting the number of politicians who favor amnesty.

Jobs, the Cobb GOP and a brewing scandal

Many thanks to Cobb GOP Chairman Joe Dendy for his kind permission for this permanently independent voter to take up space at the crowded Republican breakfast event last Saturday. As a reluctant denizen of the state Capitol, it was great to see so many of my friends and neighbors take an interest in their government.

A “what are the issues?” gathering, the morning was dedicated to more than an hour of exchanges between the Republican crowd and a large part of the Cobb GOP Statehouse delegation on what the looming General Assembly session should address.

I heard suggested topics like gun laws, taxes, transportation, voting security, mental health care and others that seemed to be mostly headline-driven.

But, it seemed that “Jobs! jobs! jobs!” was so “last year” a topic. I didn’t hear anything about unemployment. From anyone.

It is hard to decide if it is more fascinating that Georgia’s decades-long illegal immigration and illegal employment crisis was not a central issue for Founding Fathers-quoting state legislators — or that no one in the audience brought up the fact that Georgia contains more, ahem 
 “undocumented workers” than Arizona. We also have had recent unemployment rates of 8 percent to 9 percent and even higher for black and Hispanic Americans.

The estimate is that 7 percent of the Georgia workforce is made up of people who escaped capture by our Border Patrol Agents. Nobody suggested that “getting back to the Constitution” and “taking back our country” and “freedom and liberty” are elusive concepts as long as America’s antienforcement immigration policy is run by the powerful business lobby, ethnic-identity oriented liberal radicals and the illegal aliens themselves who angrily march in American streets demanding — and being promised — another amnesty. And the right to vote.

The state budget was a big issue, but not that fact that Georgia’s governor complained in 2011 that we spend at least $2.4 billion a year on illegal immigration. Or that he has now gone silent on the problem.

I predict this frog-in-the-pot mindset will change when (and if) my Republican neighbors realize that adding between 11 million and 20 million now illegal, low-wage, future Democrat biggovernment voters is not beneficial to advancing their patriotic, conservative agenda.

Nobody at the meeting brought up the fact that it has been discovered that for six years not one but two commissioners of the Georgia Department of Agriculture managed to ignore the state law passed in 2006 that requires all public employers to use the no-cost E-Verify system to help protect government jobs for legal workers. Nobody brought that up despite the frontpage Associated Press report on the Cobb & State section of this newspaper that morning.

Neither did many folks I spoke to seem to comprehend the brewing scandal right in their own Cobb County Commission backyard recently reported by the MDJ.

It goes like this: To his credit, last May, after a unanimous “Yes” vote by the Board to apply to the feds and about 18 months of processing and se-auditing of its past hiring records, Cobb Board of Commissioners Chairman Tim Lee publicly signed an agreement with the federal Immigration and Customs Enforcement agency for the BOC to become “IMAGE certified.” This was a result of a job-protection suggestion from Commissioner Bob Ott. Illegal aliens obtain jobs through fraudulent means by presenting false documents and stealing someone’s legal identity. To combat illegal employment, ICE created the no-cost Mutual Agreement between Government and Employers program in 2006. The program entails the federally certified and monitored use of the E-Verify database for newly hired employees.

But it also involves allowing ICE to inspect past hiring records to locate any phony or stolen ID documents used by all employees. The feds can detect the use of false Social Security numbers for example. Short explanation: IMAGE creates and protects jobs for legal workers by exposing illegal workers on any employers’ payroll. (I have posted a link to the official IMAGE website on my MDJ blog).

Before the primary election last July, Lee promised to “bring forward an addition to the county code that will require those doing business with Cobb to also enroll in the IMAGE program.”

The trouble is that Tim Lee now is hedging on his campaign promise and the wording of an ordinance sponsored in good faith by commissioners Ott and JoAnn Birrell came out of the commissioners’ legal department having nothing to do with requiring county contractors to be IMAGE compliant.

Quite surprised, Commissioner Ott has requested that the language of his ordinance get a do-over to actually do what he intends.

The IMAGE ordinance will be the topic of public hearings on January 22. The sound you may hear is the contractors’ lobby and the local Chamber of Commerce wailing “No!” to IMAGE.

Mr. Olens,

Please regard this as an official complaint and request for action regarding violation of OCGA 13-10-91 by the current Commissioner of the Georgia Department of Agriculture and the previous person to hold that post for clear and costly violation of this Georgia statute.

As you know, this code section requires every public employer in Georgia to register and participate in the federal work authorization program now known as E-Verify. This law was the topic of widespread, months-long national and international news attention when it was created in 2006. And when it became effective in July of 2007. And when it was altered in 2011.

According to a recent Associated Press news report, the Georgia Department of Agriculture – a public employer – was warned of the fact that it was in violation of this law in November of 2011. Even then did not rectify the violation by beginning use of the very effective E-Verify database until April of 2012. Six years after the original law was passed.
This information has reportedly been confirmed by the same office.

Current state law provides for clear penalties for violating this law, which was designed to protect public jobs for legal workers in the state. Georgia suffers from one of the highest unemployment rates and number of illegal workers and their dependents in the entire nation.

The latest report I have found is that the Pew Hispanic Center estimates that 7% of Georgia’s workforce consists of black-market labor. Our unemployment rate is officially between 8% and 9% – with minorities suffering higher rates.

Governor Deal has repeatedly estimated the cost to taxpayers of this organized crime to be at least $2.4 billion annually.

On behalf of the thousands of Georgians who have for years demanded immigration and employment law enforcement, I ask that your office take the action and use the penalties provided for in the laws to deter other Department heads and agencies from fearlessly forgetting to obey the law.

For the record, I know the current commissioner to be a good man, an outstanding citizen and a well-intentioned, valuable public servant to the people of Georgia. I am sure the same can be said of the former Commissioner. And countless other Georgians – including elected officials – who have been prosecuted for violation of Georgia law.

I have no way of knowing if or how many illegal workers may have been hired by the Agriculture Department since July 2007. Or how many American workers lost out on state employment because of illegal hiring. I don’t believe the Commissioner does either.

I am in hopes that part of any action from your office would be the requirement or recommendation of a federal audit of existing hiring records in the Agriculture Department by taking advantage of the no-cost federal IMAGE certification program that involves checking previously hired employees’ records and the ID offered during the original hiring process. This federal audit weeds out and exposes false and stolen documents used by illegal workers.

At the least, I am respectfully asking for an equal application of the law and that the people of Georgia see that laws aimed at illegal immigration and illegal hiring created by the General Assembly and signed into law by the Governor have real meaning.

UPDATE – 5:00 PM Friday – Just got a call from Cobb Commissioner Bob Ott. He tells me that he has asked that language of ordinance be changed to actually reflect requirement that Cobb contractors apply for IMAGE certification. Good work sir! Great news and great work commissioner Ott! We don’t think Chairman Lee is going to like this!

FAKE ORDINANCE! BREWING SCANDAL IN COBB COUNTY GEORGIA –

COBB COUNTY GA: This is rather like a third-world dictator scenario – Selling it as an IMAGE certification requirement, and at the direction of Cobb County Board of Commissioners recently elected Chairman Tim Lee, Cobb County code-writer Rob Hosack has produced a nonsense, scam ordinance that merely restates fed and state law for two commissioners (Bob Ott & Joann Birrell) who want and intend to create requirement that all Cobb contractors swear to application to become IMAGE certified. Anyone who has worked on legislation can easily see the scam here.

Despite the claims – and the headline – the new ordinance language is unrelated at the slightest to any part of the federal IMAGE certification program. Here is the proposed language from Hosack/Lee, sponsored by Ott & Birrell that is being presented as a requirement to apply for IMAGE certification:

Sec. 2-143. Employment of Unauthorized Aliens Prohibited. It is the policy of
Cobb County that unauthorized aliens shall not be employed to perform work on
County contracts involving the physical performance of services. Therefore, the
County shall not enter into a contract for the physical performance of services
within the State of Georgia unless the contractor shall provide evidence on
County-provided forms that it and its subcontractors have registered for and are
participating in the federal work authorization program as defined by O.C.G.A. §
13-10-90 et seq. to verify information of all newly hired employees.

13-10-90 is the definitions section for the 2006 Ga. state E-Verify law —The Cobb BOC itself signed a publicly signed their own agreement with ICE on IMAGE certification in May and they should have no confusion about the IMAGE system of protecting jobs.. This ordinance language is an intentional ruse. Anyone slightly familiar with legislation/immigration and employment verification can see what Tim Lee & Co. hope no one will.

Ott & Birrell are apparently completely unaware of the real meaning of the proposed language and the fact that it is unrelated to IMAGE in any way – or the fact that the fairy tales are now pouring out of the Cobb BOC office – or the fact that Lee now apparently even has the Cobb spokesman in on the deal.

I have had my own conversations with Robert Quigley and he has admitted to me that he knows the ordinance language is unrelated to IMAGE certification, and says they won’t consider altering it unless I come to speak at a public hearing. Uh, yeah, right. That will do it.

The truth is they think they can get this by the local newspaper and the public with a who-do-you- trust “D.A. King said, we said” scenario. To be clear- Hosack, Quigley and Tim Lee all fully understand the fact that their fairy tale may indeed work because of the ignorance of most of the public.

The MDJ reporter is honest, balanced and fair, but equally uneducated on legal language and doesn’t know who to believe. HERE is today’s news report. On the bottom is a roundup of stories and OPEDs on the IMAGE effort in Cobb from last year.

I was asked – yesterday – to resend my proposed language. Again. I had sent it several times last year at the request of Tim Lee, Ott and Birrell. It is here:

*July 1, 2013: Before any bid may be considered or any contract extended or signed, all potential contractors shall sign an affidavit swearing to having completed a valid and correct application to USCIS/ICE to become IMAGE certified. Affidavit shall contain the date of application to ICE for IMAGE certification or a copy of the ICE agreement/IMAGE certification document

Penalty for false swearing on the affidavit is the same we do for E-Verify/SAVE – see OCGA 16-10-20
Any person who knowingly and willfully makes a false, fictitious, or fraudulent statement in an affidavit submitted pursuant to this subsection shall be guilty of a violation of Code Section 16-10-20 and, upon conviction, shall be punished as provided in such Code section. Contractors and, subcontractors of any level or tier and any person convicted for false statements based on a violation of this subsection shall be prohibited from bidding on or entering into any Cobb public contract for 12 months following such conviction.

New businesses must present above within 30 days of incorporation and swear to date of incorporation.

BOC shall keep and post on official county website a list of all contractors and date of affidavit and IMAGE application/certification.
